Why Is Krispy Kreme Being Sued For $5 Million?

An (extremely) dissatisfied customer is in the process of suing doughnut chain, Krispy Kreme. What problem could he have against Krispy Kreme’s delicious doughnuts – especially when they gave them out free on Election Day – you ask? Well he’s accusing them of false advertising and fraud.

The Background

California resident Jason Saidian placed an order for Glazed Raspberry Filled, Chocolate Iced Raspberry Filled, Maple Iced Glazed and Glazed Blueberry Cake doughnuts.

However, after walking away with the doughnuts he was furious to find that the doughnuts weren’t made using real maple syrup, raspberries or blueberries.

False Claims?

Instead, according to the law suit, the blueberry products were made with imitation blueberries “that highly resemble actual blueberries due to their round shape and blue color. However, unbeknownst to consumers, the Blueberry Products uniformly do not contain any blueberries. Similarly, the raspberry and maple products do not contain actual raspberries or maple.

Saidian’s grouse is that raspberries, maple sauce and blueberries are considered ‘Premium Ingredients’ and “had plaintiff and other consumers known that the products did not contain their premium ingredients, they would not have purchased the products or would have paid significantly less for the products.”

He also adds that Krispy Kreme is capable of making doughnuts with ‘premium’ products as evidenced in their Glazed Lemon Filled and Strawberry filled doughnuts which have 100% real fruit.

Saidian is demanding $5 million from Krispy Kreme on behalf of all wronged consumers. Meanwhile, Krispy Kreme has declined to comment.
